Terms of Service
By using Confinity.ai's services, you agree to these Terms of Service. If you do not accept these Terms, do not register for an Account, or purchase, access, or use the Confinity.ai Services in any way.
01.Introduction
Confinity.ai provides AI and machine learning services, software, and support through our platform and other related websites, forums, communities, events, applications, services, software, and personnel (collectively, the “Services”). The individuals or organizations which purchase, access, or use the Services are referred to as “Customer”, “you”, or “your”.
02.Account and Eligibility
Customer is required to subscribe to one or more of our Services and all users of the Services, regardless of the level of access or permission they are granted, must register a user account (“User Account”) and agree to be bound by these Terms.
03. Fees, Auto Renewal, and Payment
Customer shall timely pay all required fees as determined by Confinity.ai in its sole discretion (the “Fees”) by a valid payment method. Confinity.ai may terminate or suspend your Account for failure to timely pay Fees, disputed charges, or chargebacks.
04.Customer Content
“Customer Content” means text, data, information, code, software, materials, designs, photos, images, media files, logos, or any other content transmitted, stored, or otherwise processed by or on behalf of Customer through the Services. You retain all rights to and ownership of your Customer Content.
05. Customer Obligations and Acceptable Use
You agree to use our Services in compliance with applicable local, state, national, and international laws and regulations. You agree not to engage in, attempt to engage in, or encourage or assist others to engage in any malicious activity while accessing or using the Services.
06. Confinity.ai’s Property and Your License Rights
All rights, title, and interest in the Services are solely and exclusively owned by or licensed to Confinity.ai. Subject to your compliance with the Agreement, you are granted a limited, non-exclusive, non-transferable, non-sublicensable, fully revocable license to access and use the Services for the sole purpose of creating, managing, and operating your applications.
07. Copyright and Infringer Policy
In accordance with the Digital Millennium Copyright Act (“DMCA”) and other applicable law, Confinity.ai has adopted a policy of terminating, in appropriate circumstances and in Confinity.ai’s sole discretion, users who are deemed to be repeat infringers of other’s copyrighted property.
08. Third-Party Services
The Services may display, permit access to or use of, install, or incorporate third-party content, promotions, websites, apps, software, services, and resources (collectively “Third-Party Services”) that are not under Confinity.ai’s control.
09. Termination and Suspension
If you are in breach of the Agreement or any other policies, terms, or agreements Confinity.ai has in place from time to time, Confinity.ai may immediately terminate or suspend the Agreement or your Account.
10. Prohibition of Hotlinking and Abuse of Services
The Customer is expressly prohibited from any form of hotlinking or illicit use of Confinity.ai’s Services. Hotlinking refers to direct linking to non-html objects (e.g., images, software, etc.) from another site for the purpose of “pulling” the object to the foreign site. Such actions are considered an abuse of our Services. Any unauthorized usage or abuse of our Services that, in Confinity.ai’s sole discretion, degrades the performance, reputation, or goodwill of Confinity.ai, or its Services, is a violation of these Terms. Confinity.ai reserves the right to terminate or suspend the Customer’s User Account without prior notice or warning, and at Confinity.ai’s sole discretion, for any reason, including, but not limited to, the violation of this section or the overall abuse of our Services.
11. Unilateral Right to Terminate or Suspend
Confinity.ai reserves the right, in its sole discretion, to terminate or suspend any Customer’s User Account at any time, for any reason or no reason, without prior notice or warning. The right of termination or suspension applies regardless of whether the Customer is found to have breached the Agreement or violated any other policies, terms, or agreements Confinity.ai has in place from time to time. This is without prejudice to any other rights or remedies that Confinity.ai may have under this Agreement or at law.
12. DISCLAIMERS
Confinity.ai implements security measures to help protect the Services from security threats. However, Confinity.ai cannot guarantee that our security measures will be error-free, that applications will always be secure, or that unauthorized third parties will never be able to defeat our security measures or those of our third-party service providers.
13. LIMITATION OF LIABILITY
EXCEPT FOR LIABILITY ARISING FROM WILLFUL OR CRIMINAL MISCONDUCT, NEITHER PARTY, ITS OWNERS, EMPLOYEES, OFFICERS, DIRECTORS, AGENTS, CONTRACTORS, AFFILIATES, SUPPLIERS, OR LICENSORS, NOR ANY OTHER PARTY INVOLVED IN CREATING, PRODUCING, OR DELIVERING THE SERVICES, WILL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES.
